1. Introduction

These Terms of Service ("Terms") govern your access to and use of Disclose ("Disclose", "we", "us", or "our"), including our website, communities, accounts, posts, comments, media features, and related services.

By creating an account or using Disclose, you agree to these Terms. If you do not agree, you must not use Disclose.

2. Eligibility

You must be old enough to use online services under the laws that apply to you. If you are under the age of majority where you live, you may only use Disclose if permitted by law and, where required, with permission from a parent or guardian.

You may not use Disclose if we have previously suspended, banned, or terminated your account unless we give you written permission.

3. Your Account

You are responsible for your account and for keeping your login details secure. You must provide accurate account information and keep it up to date.

You must not share your account, sell your account, impersonate another person, create misleading profiles, or use another person's account without permission.

4. User Content

You keep ownership of content you post, upload, or submit to Disclose, including posts, comments, images, videos, audio, and profile information.

By posting content on Disclose, you give us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, publish, distribute, modify for formatting, and make your content available as needed to operate, improve, moderate, and promote Disclose.

Public personal posts and their comments may be viewed through a direct link by people who do not have a Disclose account. Friends-only posts and community posts are limited to the audiences shown when you post them.

This licence ends when your content is deleted from Disclose, except where the content has been shared, cached, backed up, moderated, quoted, or retained for legal, safety, or technical reasons.

5. Anonymous Posts

Disclose may allow anonymous posting. Anonymous posts may hide your identity from other users, but they are not anonymous to Disclose.

We may access account information connected to anonymous posts for moderation, safety, security, abuse prevention, legal compliance, and enforcement of these Terms.

6. Acceptable Use

You agree not to use Disclose to:

• Break any law or encourage others to break the law.
• Harass, threaten, abuse, bully, or target other users.
• Post hateful, discriminatory, or dehumanising content.
• Post sexual content involving minors or exploitative content.
• Share another person's private information without permission.
• Impersonate another person, brand, organisation, or public figure.
• Upload malware, spam, scams, phishing, or harmful code.
• Manipulate likes, follows, comments, rankings, or search results.
• Evade bans, suspensions, blocks, rate limits, or restrictions.
• Interfere with or disrupt Disclose's systems or security.
• Scrape, crawl, or collect data without written permission.
• Use Disclose to sell illegal, regulated, or unsafe goods or services.
• Post content that infringes copyrights, trademarks, privacy rights, or other rights.

7. Communities

Users may create, own, moderate, and join communities. Community owners and moderators are responsible for managing their communities fairly and in line with these Terms.

We may remove communities, change community ownership, remove moderators, restrict community features, or take other action if a community violates these Terms or creates safety, legal, or security risks.

8. Moderation and Enforcement

We may review, restrict, remove, or disable access to content, accounts, comments, media, communities, or features at any time if we believe they violate these Terms, our rules, the law, or the safety of the service.

Enforcement actions may include warnings, content removal, feature limits, account restrictions, suspensions, bans, or account termination.

We may keep moderation records, including reasons, notes, reviewed content, active status, and expiry dates.

9. Blocks, Follows, Likes, and Bookmarks

Disclose includes social features such as follows, blocks, likes, bookmarks, comments, replies, and notifications. We may change, limit, remove, or reset these features to protect users, prevent abuse, or improve the service.

Bookmarks are intended to be private unless Disclose clearly states otherwise.

10. Media Uploads

You may upload images, videos, audio, and other supported media. You must only upload media that you have the right to use and share.

We may compress, resize, format, scan, remove, restrict, or block uploaded media for technical, moderation, security, or legal reasons.

11. Intellectual Property

Disclose, including its design, branding, code, features, and platform content, is owned by us or our licensors and is protected by intellectual property laws.

You may not copy, modify, reverse engineer, resell, or exploit any part of Disclose unless allowed by law or approved by us in writing.

12. Copyright Complaints

If you believe content on Disclose infringes your copyright, you may contact us with enough information for us to identify the content and review your request.

We may remove or restrict content that we believe infringes someone's rights.

13. Discs, Donations, and Paid Features

Disclose may sell Discs and may offer optional donations or other paid features. Discs are virtual items for use only within Disclose. They have no cash value and cannot be withdrawn, exchanged for money, or treated as a financial account.

Only a checkout specifically described as a Disc pack adds Discs to your balance. Custom donations do not include Discs. Unless stated otherwise, payments are not refundable except where required by law. We may remove purchased Discs following a refund, reversal, dispute, fraud, or payment error.

We may change, suspend, or discontinue Disc uses or other paid features. Buying Discs, making a donation, or holding donor status does not give you ownership of Disclose, moderation authority, or immunity from these Terms.

14. Third-Party Services

Disclose uses third-party services to operate the platform, including Vercel for hosting, Neon for database services, UploadThing for media storage, and Google for optional Google login.

Third-party services may have their own terms and privacy policies. We are not responsible for third-party websites, services, or content that we do not control.

15. Service Availability

We aim to keep Disclose available, but we do not guarantee that the service will always be online, secure, error-free, or uninterrupted.

We may change, suspend, restrict, or discontinue any part of Disclose at any time, including features, communities, accounts, limits, or access rules.

16. Termination

You may stop using Disclose at any time. You may also request account deletion where available.

We may suspend or terminate your account, remove content, or restrict access if we believe you have violated these Terms, created risk for Disclose or others, or used the service in a way that may cause legal, safety, or security issues.

17. Disclaimers

Disclose is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties about the reliability, accuracy, availability, security, or suitability of the service.

User content is created by users, not by Disclose. We do not endorse or guarantee user content.

18. Limitation of Liability

To the maximum extent permitted by law, Disclose and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, reputation, goodwill, or access to the service.

Our total liability for any claim relating to Disclose will be limited to the greater of the amount you paid us in the previous three months or NZD $100, unless a higher limit is required by law.

19. Indemnity

You agree to indemnify and hold Disclose harmless from claims, losses, liabilities, damages, costs, and expenses arising from your use of Disclose, your content, your violation of these Terms, or your violation of another person's rights.

20. Governing Law

These Terms are governed by the laws of New Zealand, unless the laws where you live require otherwise. Courts in New Zealand will have non-exclusive jurisdiction over disputes relating to these Terms or Disclose.

21. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date above.

If changes are significant, we may provide additional notice, such as through the website, account notifications, or email. Continued use of Disclose after changes take effect means you accept the updated Terms.
